HanesBrands Inc. Applicant Privacy Notice

Purpose

Hanesbrands Job Applicant Privacy Notice (the “Privacy Notice” or “Notice”) describes how Hanesbrands and its subsidiaries (collectively “we”, “our”, or “us”) collects, uses, stores, transfers, and protects your Personally Identifiable Information (“PII”) during our applicant and recruitment process. In addition, many countries have specific legal requirements governing the use of PII, which may extend to the workplace. Hanesbrands will comply with applicable laws and regulations, including local data protection laws, and will implement procedures, standards and policies wherever needed to meet these requirements.

This Notice does not apply to information collected from Hanesbrands’ employees, contractors, or temporary workers, or from  consumers or visitors of our websites and retail stores. Any such activities are respectively governed by our Worker Privacy Notice, and Consumer Privacy Notice located on our e-commerce websites. Nothing in this notice constitutes or should be interpreted as a contract and does not create any legal rights or obligations.

What Personal Information HanesBrands Collects

HanesBrands may collect and process (e.g., collect, use, store, share, or destroy) a variety of information about you to support the recruiting and application process, including but not limited to:

  • Personal identifiers, such as your name, physical address, email address, phone number, driver’s license number, social security number, passport number, visas, and work authorizations.
  • Demographic or Legally-Protected Information including your age, race, ethnicity, national origin, gender, trade union membership, veteran status, and disability status.
  • Professional and Employment-related Information, such as your resume, cover letter, education information and transcripts, work experience and professional licenses, contact information for your previous and current employers and professional references, desired salary, compensation and benefits and desire to relocate, and background check information.
  • Education Information, such as your educational background, degree and transcripts.
  • Information collected online, including public profile information from your profiles on professional sites (e.g., LinkedIn and Indeed.com), device usage history, Internet Protocol (IP) address, browse and search history, interactions with our websites and applications.
  • Audio, electronic, video or image information, such as video recordings taken if you participate in video interviews, audio recordings when you contact us, and video recording at Hanes’ facilities for security purposes.
  • Other personal information that you voluntary submit in connection with your application from employment or that you make publicly available.

Sources of your Personal Information

HanesBrands may collect your PII from a number of sources, including information provided by you, information collected by automated means or from third party sources, and information that we derive or infer about you during the recruitment process, as specified below:

  • Information You Provide, including your personal identifiers, demographic or legally-protected information, professional and employment-related information, educational background information, and other information described under “Types of PII Hanesbrands Collects” section of this notice.
  • Automatically collected information, including audio, electronic, video or image information, and information collected online as described under the “Types of PII Hanesbrands Collections” section of this Notice.
  • Information collected from other sources, including background check providers, your employment references, educational institutions, recruitment agencies, governmental agencies, and publicly available sources.  
  • Internally-generated information, such as information that we develop during our interaction with you, including job applicant identification numbers, assessments and recruiting profile information.

How Hanesbrands Uses Your Personal Information

Hanesbrands will use your PII to maintain your working relationship with our company, comply with legal obligations and our legitimate interests as an employer, or where we otherwise have your consent. Examples of how Hanesbrands will use your PII include, but are not limited to:

  • Consider your application for employment.
  • Conduct pre-employment reference checks.
  • Conduct background checks, including criminal records checks, where permitted by local law.
  • Comply with applicable legal and regulatory requirements.
  • Review and evaluate Hanesbrands’ recruitment processes and outcomes.
  • Communicate with you regarding your application and other career opportunities.
  • Any other notified purposes with your consent.

Disclosing Your Personal Information

Hanesbrands will only share your PII with those who have a legitimate need to know, which may include:

  • Hanesbrands and our subsidiary companies, with relevant Hanesbrands Human Resources representatives for the purposes defined in this Notice.
  • Service providers or contractors who perform services our behalf, such as recruiting and staffing agencies and background check providers. These third parties who provide services to Hanesbrands are required to contractually agree to put into place the appropriate privacy and security measures, as required by Hanesbrands policies as well as local laws, to properly safeguard PII.
  • Governmental agencies and legal authorities or those with legal necessity, to fulfill our company EEO obligations, to prosecute or defend a lawsuit; to protect the rights and property of Hanesbrands; and/or respond to a regulatory inquiry.
  • Any other third party with your consent and instruction for such disclosure.

Protecting You, Protecting Hanesbrands

When collecting and using your PII, Hanesbrands will follow appropriate administrative, technical, and organizational measures procedures to protect its IT systems and your PII from unauthorized access. These measures include restricting access to IT systems to only those individuals who require access for a legitimate business purpose.                 

Retention of Personal Information

If you are not accepted for the position for which you applied, your application and any PII included, may be held for up to 3 years to allow us to consider you for other career opportunities within our Company. If you accept a position within Hanesbrands, your application and PII will become a part of our employment file and will be retained for a longer period of time consistent with Hanesbrands’ policies.

Changes to this Notice

Hanesbrands reserves the right to modify this Notice as needed, to comply with changes in laws or regulations, to comply with Hanesbrands practices and procedures, to respond to new threats, or to comply with new requirements imposed by data protection authorities.

ADDITIONAL INFORMATION FOR WORKERS WHO ARE

RESIDENTS OF CALIFORNIA

This Section of our Notice applies only to Applicants who reside in California and supplements the information above. All terms not otherwise defined in this Section shall have the meanings as defined under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020, along with any implementing regulations (the “CCPA”).

Categories of Personal Information Collected About Applicants

For the categories of Personal Information that Hanesbrands has collected from Applicants who are residents of California in the 12-month period before the effective date of this Privacy Notice see the section titled the “What Personal Information Hanesbrands Collects” above.

Categories of Personal Information Disclosed to Third Parties

In the preceding 12 months, HanesBrands may have disclosed your Personal Information to the categories of third parties set forth in the “Disclosing Your PII” section of this Notice.

Use or Disclosure of Sensitive Personal Information

Sensitive information is a type of personal information that if mishandled, lost or wrongfully disclosed could cause harm to you. It may include your social security number and other governmental identifiers, financial account information and numbers with any credentials needed to access your account(s), precise geolocation, contents of email, mail and text messages, genetic and biometric data, sex life and sexual orientation, or information about your racial and ethnic origin, religion, and trade union membership.  HanesBrands will only use or disclose your sensitive Personal Information as necessary for the purposes as outlined in this Notice.

CCPA Rights

If you are a California resident, you have the following rights regarding your Personal Information:

  • Right to Delete: Subject to certain exceptions, you have the right to request that Hanesbrands delete any Personal Information about you which we have collected from you. Notwithstanding your right to delete your PII, Hanesbrands reserves the right to retain any of your PII that it is permitted or required to maintain pursuant to applicable laws or to fulfill the terms of our employment or relationship with you.
  • Right to Access: You have the right to request that Hanesbrands provide you the following information:
    • The categories and specific pieces of Personal Information Hanesbrands has collected about you.
    • The categories of sources from which your Personal Information is collected.
    • The business or commercial purpose for collecting, selling, or sharing your Personal Information.
    • The categories of third parties with whom the Hanesbrands discloses your Personal Information.
  • Right to Correct Inaccurate Personal Information: You have the right to submit a request to correct inaccurate Personal Information that we maintain about you.
  • Right to Opt Out of “Sale” or “Sharing” Personal Information: Hanesbrands does not sell or share Applicant’s PII for cross-contextual behavioral advertising.
  • Use or Disclosure of “Sensitive Personal Information”: Hanesbrands may use your Sensitive Personal Information (SPI) as required relating your work with our Company. We do not use SPI to infer characteristics about Applicants.
  • Right to Not Receive Discriminatory Treatment: You have the right not be discriminated against because you exercised any of the rights conferred by the CCPA in this Section.
  • How to Exercise Your CCPA Rights: If you are a California resident and want to exercise any of your CCPA rights described in this Section or to have an authorized agent submit a request on your behalf, please contact privacy@hanes.com.

 

ADDITIONAL INFORMATION FOR APPLICANTS OUTSIDE OF

THE UNITED STATES

         

European Economic Area (EEA), United Kingdom, and Switzerland

This portion of our Notice applies only to Applicants who reside in the European Economic Area (EEA), the United Kingdom, and Switzerland, and supplements the information above. All terms not otherwise defined in this portion shall have the meanings as defined under the General Data Protection Regulation, the Swiss Federal Act on Data Protection, the Data Protection Act 2018 as applicable.

Types of data processed, purpose, and legal basis for processing:

Under applicable law, Hanesbrands will process (collect, use, share, store or destroy) your PII under the following bases as permitted by applicable law:

  • Legitimate interest – when necessary to pursue Hanesbrands’ interest related to the operation of our business, such as managing our recruitment process or give you access to information about jobs at Hanesbrands.
  • Legal obligation – to comply with the national laws and the European Union regulations in force at the time, such as providing evidence of your right to work status.
  • Consent - in certain limited cases, we may ask for consent to use your data. Whenever we ask for consent, we will explain the situations in which we use the data and for what purposes.

International Data Transfers

If Personal Information is transferred outside of the EEA, Switzerland, or the UK, we take commercially reasonable efforts to protect such Personal Information, such as by entering into certain Standard Contractual Clauses as approved by the European Commission or the International Data Transfer Agreement or the International Data Transfer Addendum to the Standard Contractual Clauses, as approved by the United Kingdom’s Information Commissioner’s Office.

Automated Decision-Making

We do not engage in any automated decision-making as a part of our Services.

Exercising Your Rights

If you are a resident of the EEA, Switzerland, or the UK, you have the following rights regarding your Personal Information:

  • Right to Access, Rectify, or Erasure: You may request to access, to rectify inaccurate Personal Information concerning you, or to delete your Personal Information. Please note that even if you request for your Personal Information to be deleted, certain aspects may be retained by us to meet our legal or regulatory compliance, exercise, establish or defend claims, and to protect against fraudulent or abusive activity on our Services.
  • Right to Object to Processing: In certain circumstances, you have the right to object to our use of your Personal Information, such as if we are using your Personal Information for direct marketing; for our or a third party’s legitimate interests or the public’s interest; or for scientific or historical research and statistics.
  • Right to Restrict Processing: Under some circumstances, you may request that we limit how we use your Personal Information or “Restrict Processing.”
  • Right to Data Portability: You may request portability of your Personal Information, and it will be provided to you in a machine-readable or “portable” format.
  • Right to Withdraw Consent: If we have collected and processed your Personal Information with your consent, you are free to withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of processing we conducted prior to such withdrawal, nor will it affect processing of your Personal Information conducted in reliance on a legal basis other than consent.
  • Right to File a Complaint: If you have a complaint about how we use your Personal Information, you may contact us using information below and we will promptly address your concern. You may also file a complaint with the supervisory authority in your jurisdiction.
